1: Terms of Use

By using the AsianShip services, you agree to be bound by the following Terms of Use. AsianShip may contain links to third party websites. We encourage you to read the terms and conditions of each other website that you visit.

2: Prohibited Activities

AsianShip prohibits the following activities to ensure the quality of our services.

■ Criminal or unlawful activities and promoting illegal activities
■ Accessing or using the site in any manner that could overburden or impair any AsianShip server, and interfering with any other users from using the services.
■ Disrupting the networks and systems or the management of AsianShip.
■ Violating copyrights and the rights of another person including privacy and publicity, or otherwise objectionable.
■ Harassing or intimidating another (physically, psychologically or economically). The conduct that is defamatory, libelous, or invasive of another’s privacy. Especially, harvesting information of a user (a user ID, nickname, or full name) without the user’s knowledge for the purpose of harassing the individual is prohibited.
■ Expressions that promote racism, sexism, ageism, or otherwise objectionable against any group or individual.
■ Posting imagery that contains violence (picture of a corpse, of a murder scene, or grotesque photographs) or any other offensive subject matter.
■ Posting materials that contain nudity (including partial nudity) or otherwise, lascivious, obscene, profane.
■ Using words to describe sexual activities or the genitals. Posing an obscene expression.
■ Posting a link to a child pornography site or to a sexually explicit website.
■Posting a statement that encourages and promotes a self-destructive behavior of another (suicide and illegal drug abuse).
■Using our services to exploit people in a sexual and vulgar manner.
■ Using our services for election campaigns or any activities that violate the Public Officers Election Act.
■ Transmission of the following content by using the AsianShip services is prohibited.
(1) Any unsolicited advertising, promotional materials, unless otherwise authorized by InfoSeed, Inc. (AsianShip).
(2) Corporate affiliate links.
(3) “Junk mail,” “chain letters,” “spam,” “pyramid schemes,” or any other form of solicitation.
(4) Misleading to third party websites that contain adult content (including creating a link to).
(5)Any other conduct that AsianShip, Inc. defines inappropriate.
■ Sending unsolicited emails or other unsolicited communications is prohibited.
(For example, indiscriminately sending a request to be “My Friend”). The following activities are also prohibited.
(1) Message Spamming – posing or sending similar messages indiscriminately.
(2) Keyword Spamming – using the same keywords for unrelated items, and posting unreasonably lengthy materials.
(3) URL Spamming – submitting identical URLs to the site.
(4) Any other spamming activities that InfoSeed, Inc. defines.
■Please choose carefully the information that you post and provide to other users. It is unadvisable to post your telephone numbers or a back account number.
■Commercial activities or resale of merchandise is prohibited. Trading goods or bartering is not prohibited but not recommended.
■Impersonating any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
■ Collecting information about other users.
■ Copying, uploading, posting, transmitting, distributing of the copyrighted materials in the AsianShip services.
■ Obtaining more than one account.
■ Sharing an account with another.
■ Inviting strangers to your site indiscriminately.
■ Inviting a person whose account has been disabled due to the illegal activities.
■ Selling your invitation at an auction site.
■ Extended periods of inactivity, continuing membership without any “My Friend”.
■ Any other offensive and inappropriate activities.

InfoSeed, Inc. reserves the right to change unsuitable content and to take action against anyone who violates this provision, including, but not limited to, termination of a user account. The user who violates the agreement will be notified by e-mail. InfoSeed, Inc. reserves the right to terminate the membership, with or without notice. In such a case, you will not be entitled to dispute the decision, nor to file a complaint.
In some cases where judgment of violation is hard to make, a group of AsianShip personnel will meet and make a decision based upon the management standard. It might be a lengthy procedure to reach a settlement in those cases.

3: Disclosure of Your Personal Information

InfoSeed, Inc. may monitor, disclose your personal information, including the content of your emails and user activities, if requested to do so in order to comply with any valid legal process or governmental request (both domestic and international) such as court order, or search warrant.
■ Where AsianShip no longer be able to maintain its systems.
■ Where the law and the provision are violated, or where the conduct is not acceptable by the social standard.
■ Where AsianShip needs to protect its rights and of other users.

4: Disclaimers

1. You are solely responsible for your interactions with other users. InfoSeed, Inc. (AsianShip) has no obligation to monitor disputes between you and other users unless otherwise they are disruptive.
2. You use the services at your sole risk. Copyright infringement may result in civil and criminal penalties. Violators will be prosecuted.
You agree to indemnify and hold InfoSeed, Inc. harmless from and against any claim, demand, costs and expenses, including attorney's fees, arising in connection with your violation of these Terms of Use or the laws.
3. You are responsible for the content of your profile and uploaded pictures in your space. You are to respect the intellectual property and privacy of others. You are also responsible for backing up your own data and understanding the copyright infringement.
4. In no event shall InfoSeed, Inc. be liable to you for any damages or loss from your use or no use of the services. InfoSeed, Inc. reserves the right to discontinue its services for any reason at any time.

5: Member Agreement

1. By using the AsianShip services, you agree to be bound by the Terms of Use. The Terms of Use may be modified from time to time. You agree to be bound to any changes to this agreement when you use the AsianShip services.
2. You will be causing communications to be sent over the Internet, portions of which are located abroad. You acknowledge that you are bound to the laws and regulations where you are physically located at the time of transmission. You agree to abide by the applicable export control laws.

6: Proprietary Rights

You acknowledge and agree that the AsianShip services contain proprietary information that is protected by the laws as follow:
1. InfoSeed, Inc. and the corporate affiliates claim the rights and ownership in its service materials and content except those which you submit to the AsianShip services.
2. You acknowledge and agree that any necessary software used in connection with the AsianShip services (“Software”) contain proprietary and confidential information that is protected by applicable intellectual property and other laws.
3. The content available through the services or advertisements is protected by copyrights, trademarks, and trade dress.
You agree not to copy, display, transmit, distribute, rent, lease, translate, license, adapt, or recycle any portion of the AsianShip services, materials or content without obtaining the prior written consent of the owner of such proprietary rights.
It is the policy of InfoSeed, Inc. (AsianShip) to suspend membership privileges of a user who infringes the copyrights, or to remove the violated materials. InfoSeed, Inc. reserves the right to claim any profits gained by the unauthorized activities.

7: Limitation of Liability

You expressly understand and agree that AsianShip shall not be liable to you for any direct, indirect, incidental, or exemplary damages, including, but not limited to, damages for loss of profits, data or other intangible losses, resulting from: (1)the use or the inability to use the services; (2) the cost of procurement of substitute goods and services resulting from any goods, information or services purchased or obtained, or from the services; (3) unauthorized access to or alteration of your transmissions or data; (4) statements or conduct of any third party on the services; or (5) any other matter relating to the services.

8: Governing Law and Jurisdiction

These Terms of Use will be governed by the laws of Japan. If there is any dispute involving between InfoSeed, Inc. (AsianShip) and you, you agree that exclusive original jurisdiction and venue will lie in the Tokyo District Court.

9: Reporting Violations of the Terms of Use

Please report any violations of the Terms of Use to AsianShip.
